Terms and Conditions

These Terms and Conditions of sale apply to orders placed via the www.goodnight.swiss website with the ED Optometry Sàrl company headquarters at 2 chemin des Echillons - 1222 Vésenaz / Geneva - Switzerland

In placing an order, the customer specifically declares to have been informed of these Terms and Conditions and to have read and accepted them.

Ordering

By placing an order on the www.goodnight.swiss website, the customer certifies being aged 18 or over.

ED Optometry sends the customer a confirmation of the order by email as soon as the payment is accepted.

When the order is sent, the customer receives a dispatch confirmation by email.

An invoice attached to the package details its contents and their price. The invoice is dated from the dispatch of the order.

Price

The price of the glasses is shown in Swiss francs and in euros. VAT and delivery charges are included in the indicated price.

ED Optometry reserves the right to modify the prices of its products at any time without notice.

Unavailability of the glasses

Should glasses that have been ordered be temporarily unavailable, the customer will be informed by email of the expected delivery date.
If the new date is unacceptable, the customer may cancel the order by email to info@goodnight.swiss .

Acceptance of orders  

ED Optometry reserves the right to limit order quantities and to decline any order that does not fulfill the Terms and Conditions or does not meet its ethical values.

Payment and security

Orders may be settled by credit card or any recognized payment card. ED Optometry has entrusted the security of credit card transactions to Six Payment Services SA, Hardturmstrasse 201, CH-8021 Zurich. Its payment module is based on 3D Secure technology (verified by Visa or MasterCard SecureCode) and SSL (Secure Socket Layer) encryption to secure credit card payments. Delivery  

ED Optometry guarantees the delivery of high-quality glasses. Customer satisfaction is our priority.

In Switzerland, orders received before 14:00 are dispatched the same day or the next working day. The glasses are sent in a registered package by rapid delivery post. The Swiss postal service undertakes to deliver the day after the order.

Deliveries to European Union countries are sent registered by rapid delivery, handled by Deutsche Post and national postal services. The delivery might take several days depending on the country. ED Optometry accepts no responsibility for any delivery delays by a national postal service.

As mentioned in the “Ordering” section, the client receives a dispatch confirmation by email as soon as the consignment is sent. An invoice with the ordered glasses details the order and the price. The date of the invoice is the same as the date of dispatch.

The package is sent to the delivery address given by the customer when placing the order. If the package is returned to sender because the customer gave an invalid address or because it was unclaimed at the post office, for example, the customer bears the cost of resending the package.

Defects and returns

In the event of any defect or error by ED Optometry, the company is committed to rectifying the matter as soon as possible. However the glasses must be returned to us with any complaints within 15 days of receiving the goods. Any complaints made after this deadline cannot be taken into consideration.

Refunds

The return of glasses with claims for refunds must be made within 15 days after receiving the glasses. Any claims made after this deadline cannot be taken into consideration.

Glasses must be returned unused in their original pouch. The customer must also provide the reference number of the invoice. After examination and total or partial acceptance of the claim, the customer will be reimbursed on the account used for settling the order.

Confidentiality & Security:

ED Optometry keeps certain details of its customers, such as postal and email addresses, to keep in touch with them and also to comply with tax and accountancy laws in the countries from which it conducts its business. However ED Optometry guarantees that your details will never be sold or communicated to any third party, except the postal services ensuring the delivery.

Furthermore the details of your credit or bankcard will only be known to its issuer. As mentioned in the “Security & payment” section, the link between the purchase page of this site and your payment provider is secured and encrypted. There is therefore no way that ED Optometry can access or copy the data in your card.

Limit of responsibility:

ED Optometry considers that its purchase site clearly informs buyers of the following safeguards:

  • These glasses are not meant to protect your eyes from the sun
  • Do not use these glasses to look directly at the sun
  • They do not protect your eyes from artificial light such as solarium light
  • They are not suitable for protecting your eyes from impacts.
  • They should not be worn while driving or by road users
  • Clean with a dry cloth, without any cleaning agent
  • Consult your ophthalmologist regularly to adapt your corrective spectacles and check the health of your eyes

Furthermore, those with longstanding chronic insomnia and take sleeping pills should be aware that they might take longer to adapt to GoodNight® glasses than those who are mainly suffering from the effects of blue light on their natural production of melatonin.

ED Optometry declines any responsibility for the loss of data and computer or network failures in computers. Its liability is limited to gross negligence.

Modifications to the Terms and Conditions

ED Optometry reserves the right to change the Terms and Conditions at any time and without notice.

Jurisdiction and applicable law:

Only the French language version of the site is authoritative.

Swiss law is the applicable law and the courts of Canton Geneva are the only adjudicators in cases concerning our sales.
